Don't become a victim

If you are injured at work you are entitled to be compensated. But there are many traps that insurers and employers use to rob you of your entitlements.

So it vital that you follow these steps:

  1. Report the Accident - even if the injury or illness seems a minor one record it in the Accident Report book. Include the names of any witnesses.
  2. Medical Help - Let management know that you require medical attention and that you wish to see your doctor immediately.
  3. At the Doctors - you are entitled to go to a doctor of your own choice. Ask the doctor to complete a First Medical Certificate (Form 3.)
  4. Fill out a Workers Compensation Claim Form (Form 2B) - get the form from your employer, fill out the form. If you need any help ring the TWU.
  5. Give forms to the employer - give the Workers Compensation Claim Form and the First Medical Certificate to employer. Within three working days the claim must be sent to their Workers Compensation Insurer.
  6. The Insurer writes to you - within 14 days the insurer has to advise you whether they accept or deny liability or pended to get for further information.
  7. If your claim is accepted - the employer must commence weekly payment backdated to the date of injury and the Insurer to pay all medical costs. You are also entitled to have a Vocational Rehabilitation provider assist you throughout your claim. Contact the TWU for more Information.
  8. If your claim is denied or delayed then the employer or the insurer must advise you of the reason.
  9. If you don't hear anything after 17 days contact the TWU.
  10. Progress Medical Certificate - before the expiry date of the First Medical Certificate you need to go back to your doctor. If you still unfit to return to pre injury work then you need to ask the doctor to complete a Workers Compensation Progress Medical Form.
