Don't Resign if You Test Over Zero

In the last few months several Swan Transit drivers have lost their jobs after urine tests revealed alcohol in their system.

I don’t contend it is not a sackable offence to drive a bus with more than a ZERO alcohol or drugs reading. All bus drivers are required to have a 0.00 reading. That’s a given!

But, going by what I have heard, I do think Swan has jumped the gun with some drivers.

Other contractors at least will give drivers the chance to get some help if they report to work and marginally test positive.

We have previously suggested to the contractors and PTA that there should be Alcohol Testing Boxes provided in the locker rooms.

But at up to $5000 each, two per depot, 26 odd depots in the metro area alone....Bit prohibitive??

Firstly it must be said - if you have had a few the night before and can’t be sure of a 0.00 reading anymore. DONT GO!!! Ring in and book off.

IF you get to the depot and D&A testing is being conducted go to the Co-Coordinator and book off.

It may be suggested that as you have entered the depot you are presenting for work. We will deal with that if needs be.

We have heard that after the retesting, Swan drivers are being taken home or are being spoken to and informed that they are going to be terminated....unless they would rather resign.

And drivers are taking the resignation option – prematurely in my view.

If you test over ZERO at the depot – before commencing work – you should request TWU representation.

TWU Members have the right to be represented in any hearings that may occur.

Don’t go in alone and don’t agree to anything without talking to us. ONCE YOU RESIGN that’s it. You can’t change your mind.

You can’t have a think about it and decide to go for an unfair dismissal, it’s TOO LATE if you have resigned. Not my rules, but Fair Work Australia’s.

I have had to try to salvage a few people’s jobs in these circumstances.

And providing there are no ongoing issues, or the reading is not a high one, we can generally steer you toward a more sympathetic outcome.

Having said that there is no guarantee of future employment and other conditions may apply to if the job is saved.

However, I think most drivers would prefer some other form of disciplinary action than getting the boot.

So in a nutshell: Don’t drink before a shift.

And if you do have an issue let us know immediately. Don’t leave telling us until it is too late.
